At this point in the development of COVID-19 law, COVID-19 has been a sufficient reason to delay an employee’s start date, and the employee does not have to be paid until they start working. Eligibility for unemployment for that reason varies from state to state.
If an employer has a reason to withdraw an offer of employment, the employer should make sure to carefully put everything in writing and document the file. Reasons may include the employer being forced to shut down, the fact that the applicant is unable to start immediately or the potential employee is symptomatic of COVID-19
