With the advent of COVID-19, mask mandates and outright lockdowns, there are and will be many legal issues with respect to what employers may or must do during these times. (1) There are issues that exist with respect to when temporary work at home becomes permanent; (2) How does an employer provide a safe and healthy workplace?; (3) Are employers subject to reasonable accomodations, sick pay, leave of absence and business expenses?; (4) Can an employer require an employee to test for COVID-19 before they entre the workplace?; (5) What are the obligations and/or policies of a company / employer when a worker tests positive for COVID-19? (6) What should an employer do if an employee claims that they have tested positive for COVID-19; (7) Do employees have to continue to pay employees when they are exposed or test positive to COVID 19.
These are just a few of the many issues that we will see in 2021.
