LEGAL ISSUES TO CONSIDER WITH COVID-19 - PRODUCTS LIABILITY

PRODUCTS LIABILITY

ONE QUESTION THAT HAS ARISEN IS WHETHER COMPANIES HAVE A DUTY TO WARN CUSTOMERS OR CONTACTS IF IT IS AWARE THAT AN EMPLOYEE HAS TESTED POSITIVE FOR COVID-19. DO COMPANIES HAVE A DUTY TO TAKE AFFIRMATIVE ACTION TO PROTECT CUSTOMERS OR CONTACTS THAT COME INTO CONTACT WITH AN INFECTED EMPLOYEE?  A POSSIBLE DEFENSE COULD BE WHETHER COMPANIES ARE RELYING ON FEDERAL, STATE OR LOCAL RE-OPENING GUIDELINES.  DOES A COMPANY HAVE LIABILITY FOR PRODUCTS THAT HAVE BEEN CONTAMINATED.  FINALLY, ARE HEALTHCARE COMPANIES LIABLE FOR INADEQUATE TREATMENT OF COVID-19 PATIENTS.
